On the last Friday, June 12th, 2020, the Law nº. 14.1010 was published in the Union’s Official Gazette, which deals with Private Law relations during the coronavirus pandemic period.
Among the provisions, we highlight changes in the Personal Data Protection Law, Consumer Protection Code, Civil Code and Competition Law, as noted below:
(i) Postponement of the entry into force of the LGPD’s articles regarding its penalties to 08.01.2021;
(ii) Suspension of the limitations period from 06.12.2020 to 10.30.2020. Also applied to the term of real estate properties acquisition through usucaption;
(iii) Suspension of the 7-day period for withdrawal from the consumer in case of delivery of perishable products, immediate consumption and medications;
(iv) Suspension of the economic order infractions through the sale of goods or provision of services unreasonably below the price, closure of the company’s activities without just cause, or concentration through an associative contract, consortium or joint venture between 2 or more companies;
(v) Authorization for General and Condominium Meetings to be held by electronic means until 10.30.2020, although there is no provision in the legal entity’s constitutive acts;
(vi) Deferral of the initial term for the inventory and partition’s establishment from the opening of the succession to 10.30.2020.
